Business Marketing Consultants – Marketing by Social Media

We signed a six month contract with a remax agent in Missouri to sell our house. He first listed it 36K below market value because the way the market has been. Recently I noticed he dropped it another 10K without consulting us. We will barely cash out with paying off the loan and his commission. Not to mention the fact that he has failed to uphold a lot of what he stated he would do if we listed the house with him. Is this allowable? Would you believe this is grounds to be able to break the sale contract with him?

Not his decision. I would bust him out.

    He's not allowed to do that with first consulting with you. Break the contract. Talk to other real estate agents ( they'll be happy for your business ) about it and they can direct you for the best approach.

    You most definetly have grounds to break the contract. I would suggest you get your copy of the contract–call him and tell him the deal is off. When he tries to intimidate you with legalities tell him you are considering suing him for breach of contract. Even if he gets a buyer, you are not obligated to sell, no matter what the price.     I live in Kansas City, MO and though I have held a real estate license never in the state of MO. My first question I wonder is where in the state are you because our neighbor is selling houses left and right and she is not coming down in prices.

    Unless you have a very pricing house and that 10K was his commission he just gave up. The reality is that he works for you – contact the broker at Remax or contact the real estate licensing board and gather information and then make your decision.

    I never ever drop the price and do not know anyone that has but make sure that you protect yourself every step of the way and find out the rest of the story first.

    Although I do not specifically know the laws in Missouri, most states require the sellers' signature for a change in price other than the price you agreed to list the home at in your contract with the agent.
    First, call your agent's office and ask to speak with the managing broker. Alert them that you are unhappy with your agent's performance and tell them about the price change without your consent. Inform them that if immediate action is not taken, you will go to the state Department of Real Estate.
    Then, call your local Association of Realtors, as this is also an ethics violation.
    Finally, call your state Department of Real Estate and put in a complaint. Your agent could be subject to fines, penalties and possible suspension or forfeiture of his license.
    Start interviewing other agents, and ask friends, family & co-workers for recommendations!
